AN ‘UNDERSTANDING’ THAT CAN PROVE FATAL

New Delhi has reasons to be worried by the fast pace with which China is building dams along rivers that impact India

Faced with an acute shortage of water and energy resources to meet the needs of a burgeoning population, China has turned to exploit the Tibetan rivers and is now in a damming spree in the Brahmaputra river (Yarlung Tsangpo) to fulfil its increasing needs. Hence after constructing the two inter-linking canals, the eastern and the central routes, to transfer water from the water endowed south to the arid northern areas in 2014, it has operationalised  recently the Zangmu project, the largest hydropower facility located in the middle reaches of the river, raising concerns for India.
This project is to be followed by five more dams upstream for power generation. The Shuomatan project, the Great Bend project near Indian border, is also being planned by the Chinese to divert the Brahmaputra waters to its north areas through the third link canal, the western route.
Though our neighbour has been insisting time and again that their projects being run-of-the river schemes would not affect downstream flows, the deep reservoirs built with sufficiently large storage capacities at such projects and the highly snow melt yield at the sites could be diverted by the Chinese  through tunnel intakes to create artificial water scarcity downstream. Further, simultaneous opening of the project gates could result in man-made floods downstream. However, China has assured that it would be providing more river flow data as per the ‘Understanding’ signed in 2013 and that India need not be unduly perturbed over Chinese projects in Yarlung Tsangpo.
A perusal of the existing ‘Understanding’ would reveal that it deals only with regard to exchange of flow data between the countries, and hence, it is not a guarantee to allay our fears of floods and  water scarcity in Brahmaputra, arising particularly during conflicts.
For taking care of such situations, we have to have a high dam with a storage capacity adequate to absorb the floods from upstream and also to contain high water level fluctuations in the river due to indiscriminate operation of upstream Chinese reservoirs, as presently there are no such structures downstream in the river. Therefore, such a project is strategically important for India.
Looking at the experience of the Mekong river basin countries with China, we should not remain complacent with the ‘Understanding’ and the assurances offered by
our neighbour. We need to put the country’s strategies in place well in time,  so that our national interests are insured against  future developments. This is all the more necessary since projects like the High Dam take years to be implemented to address the concerns arising out of the Chinese projects.
However, our relevant ministry is yet to start work. Leave alone construction, even preliminary works for taking up this strategically important project are still to be initiated by the authorities. In fact, succumbing to the diktats of environmental activists and groups, authorities have put a complete ban on the design and approval of new water resource development projects, till the committee set up by the Government some time back submits its report on environmental flows (e-flows) required for all the rivers in the country. Hence, all such projects, including the Brahmaputra High Dam, the river-linking project, the India-Nepal Pancheshwar project etc, irrespective of whether they are strategically important or not, will have to wait till the committee’s report on e-flow is finalised!
Unfortunately, even after conceiving this project more than a decade ago in the aftermath of floods resulting from the failure of a Chinese dam in 2000, our authorities continue to be lackadaisical in their approach regarding the construction of the project. This is sure to cost heavily to the country since, for want of a storage dam we would have to depend on China for the release of waters during the dry season and for protection from floods during the wet season.
Added to this situation is the likely security threats arising from the Tibetan liquid bombs during periods of conflicts with our neighbour. We cannot ignore history.

To facilitate an early Teesta accord, it is necessary to expedite and complete the Manas-Sankosh-Teesta-Ganga canal project, which can augment flows in the Teesta during the lean season. The Union Government has to act fast


Prime Minister Narendra Modi’s recent visit to Bangladesh scripted a new chapter in India-Bangladesh relations. New Delhi and Dhaka should now move forward and find a solution to the most vexatious issue — the Teesta river issue, which has been under discussion since a long time.
It is unfortunate that this issue is stuck in the whirlpool of India’s internal hydro-politics. It has also raised some lingering doubts in our neighbourhood about our seriousness on the issue. Consensus building with West Bengal in this regard has been a complex and arduous task, thereby resulting in our failure to make any breakthrough in the proposed sharing agreement.
The Teesta river originates in Sikkim, flows past Jalpaiguri in West Bengal and then joins the Brahmaputra river in Bangladesh. It has a drainage area of 12,729 sq km, of which 83 per cent is situated in the Indian territory.
Presently, the river valley projects implemented in Sikkim are all hydro-projects that have no impact on the river flow. But the Gajoldoba barrage in West Bengal, situated about 90 km upstream of the international border with Bangladesh, envisages irrigation, water supply and also power generation.
Similarly, the Dalia barrage in Bangladesh, constructed 15 km downstream of the border, envisages irrigation and other benefits. During the non-monsoon period, between November to April, both experience shortage of water for irrigation.
Teesta is one of the 54 rivers that flow through the India-Bangladesh border. Of these, nine, including the Ganga and the Teesta river, are important, on which water-sharing issues between the two countries had cropped up. In 1996, the Ganga water-sharing agreement was signed, but discussions on others are still going on.
Since 1972, Bangladesh had been insisting on a 50 per cent share of Teesta waters to meet its requirements. However, after prolonged discussions, in 1983, an ‘understanding on an ad hoc sharing’ of Teesta river flows in lean season was reached between the two countries so as to help our neighbour get financial assistance for the construction of the Dalia barrage.
According to this ‘understanding’, of the dry season river flows, Bangladesh got 36 per cent of the share and India got 39 per cent while the remaining 25 per cent remained unallocated, pending further discussions.
Many factors have been considered by Delhi to arrive at a workable solution to the water-sharing issue. It was felt that since there is a likely regeneration of 25 per cent flows between the Indian and Bangladesh barrages across the Teesta, the additional 25 per cent sought by our neighbour during the lean season can be released by West Bengal.
However, the State Government was not willing to  release water from its barrage as it apprehended that a major project envisaging irrigation of 9.22 lakh hectare and power generation of 67.5 mw could be affected if this water is spared to Bangladesh.
West Bengal has its own reasons for not making any commitment to release water from its barrage. The main reason is the uncertainty of requisite quantum of river flows during the summer months. Hence, to make the Teesta water-sharing a reality, the only available alternative is to augment the river flows during the non-monsoon months.
In this connection, the Indian river-linking project offers an excellent opportunity to improve the Teesta river flows.
The Manas-Sankosh-Teesta-Ganga link canal is one of the major proposals under the Himalayan component of the IRL project. It envisages diversion of the surplus waters from the rivers like Manas and Sankosh (tributaries of the Brahmaputra river), to Ganga and beyond upto Mahanadi and thereafter towards south to meet the requirement of water short areas.
By incorporating the necessary provisions in the canal structures, it is possible to release from the MSTG canal, the requisite waters into the Teesta at a point upstream of the Gajoldoba barrage during the lean season to augment the river flows.
In such a situation, West Bengal will be able to release the needed flows downstream to fulfil the water-sharing agreement with Bangladesh.
Bangladesh has been raising objections against India’s IRL project, pointing out that the project will affect the water availability downstream in their rivers. Since, in addition to Teesta, the MSTG link canal can also augment the river flows in the Ganga in a similar way, it is possible to convince our neighbour that the Teesta project, when implemented, can be a win-win situation for both the countries.
In view of these facts, to facilitate an early Teesta accord, it is necessary to expedite and complete the MSTG canal project which can augment flows in the Teesta during the lean season. The Government of India has to act fast in this regard.

Time To Look At Teesta

Delhi must now prioritise settling the water-sharing issue with Dhaka

Having resolved the longstanding issue of enclaves during the prime minister’s recent visit to Bangladesh, New Delhi has to focus now on other bilateral issues, the most contentious one being the sharing of Teesta waters. Though the PM’s visit has significantly contributed to removing some of the mistrust that plagued India-Bangladesh relations, a strong sense of disappointment is evident in the local media about the failure to make a breakthrough on water-sharing.
Sikkim has constructed some hydro-power projects across the Teesta, but these do not cause any impact on the flow downstream. However, there are two irrigation projects on the Teesta, a barrage at Gajoldoba in West Bengal and another at Dalia in Bangladesh, which draw water from the river to meet irrigation needs. The dispute about Teesta waters arose mainly because of the shortage of water during the dry months.
Since 1972, Bangladesh has been insisting that a 50 per cent share of Teesta waters be made available to the lower riparian country to meet its requirements. In July 1983, an “understanding” on an ad hoc sharing of waters was reached to help Bangladesh get financial assistance for constructing the Dalia barrage. According to this, Bangladesh would get a share of 36 per cent of the lean season flows and India 39 per cent, while the remaining 25 per cent would remain unallocated pending further discussion.
India has been examining many parameters for arriving at a workable solution. A possible option considered was that — since the regeneration of flow in the river channel between the Gajoldoba and Dalia barrages is about 25 per cent, which would be available at the downstream barrage — the additional 25 per cent demanded by Bangladesh could be released by West Bengal from the upstream barrage. But the state had its own compulsions for meeting irrigation needs as the summer flows are generally erratic. Hence, West Bengal did not want to commit to releasing water from the upstream barrage, at the cost of its major project envisaging the irrigation of 9.22 lakh hectares in the ultimate stage. Thus, the water-sharing arrangement got embroiled in domestic hydro-politics, stalling further action to find an acceptable solution to the dispute.
It is apparent that to make Teesta water-sharing a reality, there is a need to augment the river flows during the non-monsoon months, without which West Bengal would not allow further discussion on the subject. The deficit in flows can be met by the transfer of water from other water-endowed basins. In this connection, the proposals made in the Indian River Linking (IRL) project could be considered. The Manas-Sankosh-Teesta-Ganga (MSTG) link canal is one of the links proposed under the Himalayan component of the IRL. It envisages diversion of the surplus waters of the Manas and Sankosh rivers to the Teesta, Ganga and beyond, to meet the requirements of water-deficit areas. By making suitable provisions in the link canal, it should be possible to release the required water into the Teesta during the summer to augment river flows, thus meeting the requirements being proposed for water-sharing with Bangladesh.
It would be of interest to note here that while the IRL project was being deliberated on by India, Bangladesh had been raising objections, stating that it would affect water availability downstream. Since India would be augmenting the Teesta flows from the IRL project, to counter Bangladesh’s objection, we could also make provisions in the MSTG canal to augment river flows in the Ganga in a similar way. It would then be possible to convince our neighbour that the project would be a win-win for both countries.
The Centre must, therefore, act fast and expedite the implementation of the proposed MSTG link.

The Indian Meteorological Department warned of poor rains this year, which was ominous for the country as most of its agriculture is dependent on the monsoon rains. As the spectre of drought loomed, the question that comes to mind is: why have we failed to implement a national water grid plan, even after years of detailed investigation and study for the proposed Indian river linking (IRL) project? The proposal had envisaged diverting the surplus waters of the Brahmaputra to the water-deficient Cauvery and beyond, through 30 links that would bring additional irrigation to 35 million hectares, generate power and supply drinking water to drought-prone areas.
The proposal for the mega IRL project is gathering dust because it got mired in the complexities of hydropolitics among the states, kept alive by corrupt politicians, as well as activists and academics masquerading as the guardians of the environment. Water-rich states were not willing to share their surplus with water-deficit states, arguing that they did not have any water to spare, given their future plans. In this fight between the states, the Union government remained a helpless spectator, pleading that water was a state subject under the Constitution. Even though Entry 56 of List 1 of the Seventh Schedule of the Constitution empowers the Centre to regulate interstate rivers, it did not use these powers. The Centre’s inaction meant that project work did not progress as scheduled, since more than 80 per cent of the country’s annual utilisable water resources is carried by interstate rivers.
The annual occurrence of  floods and droughts proved to be a boon for corrupt officials and politicians as they could reap illegal benefits from the relief doled out. So they remained opposed to a long-term plan like the IRL project. At the same time, a motley group of activists and academics interested in remaining in the limelight were busy spreading misinformation about the project, raising the bogey of environmental degradation.
Misrepresenting ground realities, they offered textbook solutions as alternatives to the river linking project.
They lacked the honesty to appreciate the evidence from existing river linking projects that contradicted their ideological fantasies. According to these groups, any river should be left in its pristine condition to protect its ecology and biodiversity all the way up to the sea. According to them, major dams like Bhakra had brought only disaster to the country — the eco-friendly inundation canals and village tanks of the past could meet all the food requirements then and they would be adequate even now.
The project has also been criticised by the prophets of doom, who point out that its canal system would become an open sewer spreading across the length and breath of the country. Ever critical of developmental efforts, these cynics had earlier condemned the Golden Quadrilateral project for national highways as a network of conveyor belts for noxious emissions.
These all-knowing experts appear to be ignorant of the facts recorded in the district gazetteers, about the famines that would occur before dams like Bhakra were constructed. They are also afflicted by bouts of amnesia about the massive water transfers, implemented through water trains, to drought affected areas in the recent past, when the traditional tanks had dried up and the “small is beautiful” ideology had failed.
Infrastructure transferring water from surplus to deficit areas was constructed in the past and is still serving without causing environmental disaster — for example, the Western Yamuna Canal and the Kurnool-Kadapa Canal. If our forefathers had not taken timely action to harness the water resources by constructing dams and canal systems, and left the rivers in their pristine condition, by now, we would have been begging for food to meet the needs of our growing millions.
Since water has been made a political issue, none of the water-rich states will accept that it has a surplus. A change in this attitude can be brought about if the states can be convinced of the benefits of being able to spare water. If these states could be compensated for the water they can spare as surplus, they would certainly agree to the project, as they could use the compensation to meet the needs of their future plans. The quantum of compensation could be decided on the basis of agreed criteria. As both the donor and the recipient state would benefit from this provision, it would  be a win-win situation for all, fostering a water-saving culture among the states.
We have lost decades in implementing the IRL project. Too much analysis has paralysed us into inaction. Future generations will not pardon us for this inaction.

Introduction

Banki Moon, U.N. Secretary General, has recently warned the global community that the planet earth is facing a severe water crisis and the scarcity of this natural resource would be a potential fuel for wars and conflict. He was concerned of the indifference and inaction of the governments concerned in taking steps to prevent instances of the resource being spoiled, wasted and degraded.(1)
This is not the first time that such fears were expressed of looming water wars by leaders of international organizations. In the ninetees, Ismail Serageldin, then Vice President of the World Bank had stated that the wars of the 21st century would be about water and not oil (2).. Also on the occasion of the World Water Day, 2002, the message from the then UN Secretary General, Kofi Annan was cryptic that “fierce national competition over water resources has prompted fears that the water issues contain the seeds of violent conflict.”(3).
   The fears are real since misuse of the resource and poor management practices have been causing depleted supplies, falling water tables, shrinking inland lakes and stream flows diminished to ecologically unsafe levels thereby leading most parts of the world to the threshold of water famine. High population growth, rising consumption and pollution have posed significant threats on fresh water availability and climate change is also making a  bad situation worse. Hence the threats of water wars are heading  to become a reality as we are  facing an unprecedented  demand  on the relatively decreasing natural resource of fresh water supplies and there is no substitute available to replace the natural  resource like water.
Recent Studies
In this connection,a recent report  on global water security released by US Secretary of State, Hillary Clinton, on the occasion of the World Water Day, 2012 is relevant (4). It has  brought out  the risk of water wars in the coming decades. The report, based on the assessment of Federal Intelligence Agencies, has concluded that lack of fresh water to meet the demands of a surging population would create tensions within and between the states causing global instability and conflict. The report has also cautioned about the use of water as a weapon of war or a tool of terrorism becoming a reality in the near future.
  Another interesting study published in the Journal of the US National Academy of Sciences by David Zhang recently, based on the data of more than 8000 wars in the past had established that the resource shortage was the main cause for triggering these wars.(5).
  Water is a gift of nature playing an important role not only in the origin of civilization, but also in the overall development of the social fabric. Most of the world’s water is saline and only 2.5% is fresh. A major part of this fresh water , almost  97% is tied up in ice, permanent snow and fossil ground water and only the remaining 3% alone is renewable and available for use as surface and ground water. Human use of water has increased more than 35 folds over the past 3 centuries. According to studies  by International Water Management Institute, nearly 1.4 billion people  amounting to a quarter of the world population, or a third of the population in developing countries would be experiencing severe water scarcity by 2025.(6)
Legal Status on Use of International Rivers.
There are more than 260 international rivers covering almost one half of the surface of globe, and an untold number of shared aquifers providing fresh water to people settled within these basins. Many of the participating basin states look at the administrative boundaries as the basis for decision making ignoring the fact that rivers do not recognize political boundaries and legal generalizations. Hence it has been a cause  of legal battles and consequent political tensions between countries in various continents .
International laws that govern the use of transboundary rivers is poorly developed. In 1997, UN attempted to develop a frame work on the issue and adopted the’ Convention on Non-navigational Uses of International Water Courses’, but it is still to be ratified to come into force. Though it sets out  many important principles for cooperation  and joint management of such waters and provide practical guidelines for allocations, no practical enforcement mechanism exists in the text to back up the decisions of the final arbiter- the International Court of justice. Further it institutionalizes the two conflicting principles in the upstream- downstream uses of an international waterway by emphasizing both on ‘equitable use’ and ‘an obligation not to cause significant harm.’ These would enable the upstream users to stress on the principle of equitable use, while the downstream riparians would demand the protection of their existing uses under the provision of no significant harm and might thereby trigger further disputes.
Water Wars- a Myth or Reality?
Many analysts do not subscribe to the view that water  would become a source for wars in this century. Water wars are not economically viable, they argue. For the cost of a day’s war, alternative sources such as de –salinisation plants could be built to meet the water needs, they claim. They also point out that the past history on wars does not indicate any full-fledged battle for using river waters and the recorded disputes were all for controlling navigational rights on these rivers.
The earliest documented conflict over water use  is the dispute between the Sumarian city states of Lagash and Umma over the right to exploit boundary channels along the Tigris sometime  during 2500 BC.
We have also witnessed a number of water related conflicts in the last century. To name a few, in 1958, the Nile waters were the cause for tension between Egypt and Sudan. Guns boomed in the conflict between Israel and her neighbours in 1967 as the Arabs wanted to divert the waters of the Jordan river system. In 1975, the dispute regarding the flows in the Euphrates brought out a hostile situation between Iraq and Syria. Confrontation occurred between Mauritania and Senegal on the Senegal river in 1989.
Water Treaties and Their Resilience.
While historic reality does not point out to a full scale war over water, the newly added problems of climate change and increase in pollution further affecting the water availability are leading to an environment more conducive to trigger a military conflict. However, some war analysts are of the view that if the states sharing the international rivers conclude treaties and establish water regimes, such agreements are resilient enough to survive conflict inducing situations. To justify their stand, they cite the Indus Waters Treaty (1960) between India and Pakistan for sharing the waters of the Indus river as a model which survived two wars and many war like situations between the two countries. They also point out that there are many more such treaties and agreements entered into by some of the cobasin states during the last century to optimally share and use their water resources due to which many potential threats  have been averted.
The contention of these analysts that the inbuilt resilience in the existing water treaties
  and agreements is adequate to prevent  wars has also its limitations, as an in depth study of such agreements show  that some biassed provisions in the agreements on sharing common rivers have brought out fresh problems . When scarcity looms large, these provisions could be exploited by one party to its advantage ignoring the interests of other parties and this could lead to an environment conducive to trigger conflicts. It is also seen that based on their past experience in the working of the agreements, many of the parties who are signatories to the existing treaties are pressing for renegotiating the terms with their counter parts as they feel that they have been taken for a  ride while signing the agreements.(7)
Take for example the 50 year old history of the Indus Waters Treaty(1960) between India and Pakistan. It is the story of a tragedy that began with hope as demonstrated by past events. It has failed  not only in accomplishing its objective of optimum development and utilization of the Indus waters, but also in settling water disputes between the two all these years. India feels aggrieved that it had to sign the treaty which ignored its rightful share of more than 40% of the Indus waters and gave it only about 20% in the water allocation, due to World Bank using a concept of equally dividing the tributaries instead of equitably dividing the resource as per international norms. The disputes are continuing with no solution in sight as Pakistan is not willing to renegotiate and review the provisions in the treaty.
The peace brought about by the treaty signed between USA and Mexico on the Colorado river (1944) is under threat since recently Washington took the unilateral decision of lining parts of  the All American Canal bordering Mexico ignoring the provisions and the latter objected to that action. U S took the stand that the canal being located in American territory and the water flowing through that being California’s share of the Colorado river water, it had every right to take a sovereign decision to line it  with the objective to make more water available to its people by preventing seepage loss. Mexican government disputed this right basing its case on the principle that their farmers of Mexicali valley adjoining the border  had established a beneficial use of the seepage water  since decades, giving them the right under the treaty. The  tempers are rising on the issue between the two countries.
Like wise, the project initiated by US unilaterally without consulting Canada for the  diversion of water  from North Dakota’s Devil’s Lake to Manitoba (Canada) ignoring the provisions in the Boundary Water Treaty (1909) has been objected to by the latter as it feared that the proposal would damage their ecosystem. Canada pointed out that the proposal should have been discussed and approved by the International Joint Commission (IJC) set up by the two under the treaty which had been handling all trans–boundary water issues for more than 100 years. But US is poised to go ahead with the scheme bypassing the IJC and ignoring Canada’s protests. This has resulted in strained relationship between the two.
In South America, the Itaipu treaty signed in 1973 between Paraguay and Brazil for the optimum utilization of the Parana river for power generation, has opened up disputes on the benefits accrued. According to Paraguay, Brazil got undue benefits as the former had to invariably sell all its surplus energy to  the latter at cheap rates as per the treaty provisions. Paraguay wanted to renegotiate the terms but Brazil is not willing till the treaty lapses in 2023.
In Africa, a battle of control over the Nile has broken out between Egypt and  the countries of Sub-Saharan Africa with the latter complaining that they have been denied the due share of  the Nile water as per the existing treaty (1929). Flouting the treaty provisions, Tanzania plans to build a 105 mile long pipeline for drawing out water from lake Victoria which feeds the Nile river.
 Uneasy calm continues to prevail between Mauritania and Senegal on the Senegal river. The co-basin states, Mozambique,  Zambia and Zimbabwe sharing the Chobe waters are still to come to terms with the present situation.
The  long standing disputes between Portugal and Spain on their common rivers could be settled by their signing the ‘Convention’ concerning the management of their shared river basins in  November,1998 and adopted by both the countries in January 2000. However, according to media reports, the worst drought of 2005, has resulted in fresh  disputes over 
sharing the Tagus and Douro waters in spite of the standing agreement.
 Like wise, though the dispute between Hungary and Slovakia on the Danube  river has been settled at the instance of the International Court of Justice, many legal questions are being raised on the outcome of the court decisions.
 Similarly, the disputes on the waters of Amu  Daria and Syr Daria draining into the Aral Sea are waiting to erupt  into major conflict among the Central Asian Republics.
Troubles are brewing in Asia with the Chinese proposals to divert the waters of the Mekong, Yarlung-Tsangpo and Salween to its  dry north, in spite of protests from the downstream countries as also from the Mekong River Commission. Interestingly, China is not a party to any treaty with its neighbours regarding the sharing of its transboundary rivers.
There are many more such simmering disputes on the use of common rivers all over the world.The examples shown above reveal that even in spite of existing agreements, many nations continue to feel that they have not been able to get their due in their common rivers. As the demand for water is increasing by leaps and bounds to meet the aspirations and requirements of a surging world  population , and the scarcity is becoming a reality, there is every possibility of the bickering countries taking the conflicts to the battle fields.
Actions Needed.
The root cause  of any conflict is the scarcity of the resource as brought out in many studies carried out on the subject and in this case it is water. Hence the solution lies in improving its availability. For this purpose, supply and demand management aspects have to be analysed for an effective strategy and to provide for concrete solutions. These include adoption of techniques for improved water availability such as water conservation and pollution prevention, improving conveyance and water use efficiencies, recycling and reuse of drainage water. These actions have to be taken both within and among the basin nations to avert the crisis. The task is a daunting one. The problem is complex and multisectoral, and the solution involves in correcting decades of mismanagement of this resource.  In the present context of socioeconomic and ecological problems of development under the conditions of severe demographic pressures, there is urgent need to take up measures as above to improve the availability of the resource.
 Conclusion.
Water is available to meet everybody’s need, but not adequate to meet their greed. This fact has to be recognized by all stake holders to work together to make the optimum utilization of the available resource. International organizations have to take a greater  institutional role to start dialogues among the contending states to impress upon them to share the limited resource to meet their water needs rather than insist on their  water rights and to develop a sustainable arrangement in this regard. It would then be possible to  mitigate the conflict inducing characteristics of water by taking adequate measures now itself, instead of waiting for the flash point to occur.
